Travel Insurance
Article 1 - Definitions
POLICY NO. 04/100.032/01
INSURER: AIDE Asistencia Seguros y reaseguros s.a., who signs this insurance contract with the Policy Holder, assuming the risks that are contracted and guaranteed in the Specific Conditions of this Contract.
POLICY HOLDER: The Travel and Tourism Agency or Tourism Operator, who signs this insurance contract and is responsible for the organisation and sale of the travel programme, as well as the payment of the premium.
INSURED PERSON: The Customers of the Policy Holder, who are resident in Portugal, holders of a travel document and included on the lists of Insured Persons to be submitted to the Insurer.
COMPANION: Companions are understood to be Insured Persons who participate in the same travel programme from the same travel agent or operator, who are also holders of this insurance contract and who have a family or work relationship with the Insured Person.
SPOUSE: This includes a spouse by de facto relationship, in addition to a spouse by marriage.
ACCIDENT: Any chance, sudden or abnormal event that occurs due to factors outside the will and control of the Insured Person and produces bodily injuries.
ILLNESS: Any sickness that afflicts the Insured Person and prevents them from commencing or continuing their journey.
LOSS: Any chance, sudden or unpredicted event, or series of events resulting from the same cause, that may activate the guarantees included in this Contract.
START OF COVER: The date that the Insurer receives the insurance policy. This should coincide with the enrolment date on the travel programme, and there no longer than 5 days should elapse between enrolment and informing the Insurer.
END OF COVER: For the Travel Cancellation Guarantee, this will end at the start of the travel programme, which is considered as the first service provided. For the Travel Termination Guarantee, the end of the cover period coincides with the return date.
IRRECOVERABLE COSTS: Accommodation, transport and other expenses included in the initial travel programme. These should be duly verified by the Service provider, from whom proof of the non-recoverability of the cost should be obtained.
Article 2 – Territorial Scope
The Travel Cancellation Guarantee is valid for Portugal and the Travel Termination Guarantee is valid worldwide.
Article 3 - Validity
This policy is only valid if it is included in the travel programme at the time of enrolment and all conditions have been met in the case of loss.
In order to claim against the guarantees, the Insured Person must be normally resident in Portugal. The maximum validity period is as follows: For cancellations, 90 days prior to the departure date for Cruises and Safaris, and 45 days for all other journeys. For terminations, 30 days after the start of the journey.
Article 4 – Early Cancellation of a Journey
The Insurer guarantees to refund the irrecoverable costs resulting from a Travel Cancellation up to a limit of €10,000.00, if the Insured Person and a maximum of 4 (four) companions cancel a journey for any of the following reasons:
1.1 Death, Serious Accident or Serious Illness affecting:
1.1.1 The Insured Person, their spouse, or 1st or 2nd degree ascendants or descendants of either, as well as: siblings, brothers-in-law, sisters-in-law, sons-in-law and daughters-in-law of either.
For the purposes of this item, a serious accident or illness is considered any sudden, unpredictable or non pre-existing clinical condition that places life at risk and necessitates more than 1 day of hospital internment.
In both cases it must be supported by a medical report to be supplied by the Insured Person and verified by the Insurer.
1.1.2 The person whose duty it is, during the period of travel of the Insured Person, to take care of minors or other dependent relatives who are legally in their charge.
For the purposes of this item, a serious accident or illness is considered any sudden, unpredictable or non pre-existing clinical condition that necessitates official disability leave to be issued by the Social Security Services, and impedes the performance of professional duties.
1.2.5 Relocation of the company where the Insured Person works, as long as this is to a different Municipality to the original location, or to a different Municipality to where the Insured Person is normally resident.
1.2.6 Redundancy of the Insured Person in the two weeks preceding the departure date, if they had a permanent contract and if the six-month probation period had already expired.
1.2.7 If the Insured Person is a salaried employee and the company where they work commences legal liquidation proceedings during the validity period of this guarantee.
1.2.8 If the Insured Person is a salaried employee and the company has not paid their monthly salary, and there are legal proceedings to settle the remuneration owed. Solely in this case, the refund can be made up to three months following the cancellation.
1.2.9 Theft of essential travel documentation in the five days preceding the start of the journey.
1.2.10 If the Insured Person or their spouse wins a travel package in a public lottery, before a notary, and the package must be used in a period that overlaps with the journey.
1.2.11 Any illness of Insured Persons under 2 years of age which prevents them from travelling. This should be duly verified by the Insurer's Medical Services.
1.2.12 Persons who are called to testify as witnesses in court.
1.2.13 Persons who are called count votes in the following elections: Presidential, European, General and Local.
1.2.14 Persons who receive an unexpected call for a surgical operation.
1.2.15 Persons who are called for an organ transplant.
1.2.16 Complications in the first six months of pregnancy, except if predicted, of the Insured Person, their spouse or people in their charge.
1.2.17 Reception of an adopted child.
1.2.18 Receipt of a notice from the Ministry of Finance to settle IRS tax debts of over €2,000.00.
3 This contract also guarantees the refund of irrecoverable costs resulting from a travel cancellation in the following circumstances:
3.1 Inhabitability of the Insured Person’s destination Hotel (or equivalent), due to a serious loss resulting from: earthquake, flood, fire, explosion (not cause by any of the exclusions described in article 7), landslide, falling celestial bodies, typhoon, hurricane, cyclone, lightning, deluge or overflow of natural or artificial water courses.
3.2 Declaration of a disaster area by the local authorities at the travel destination, or the national authorities of the country of origin, which renders the travel package acquired by the Insured Person unusable, as long as this occurs in the two weeks preceding the departure date. The following types of disaster are covered: earthquake, flood, fire, explosion (not cause by any of the exclusions described in article 7), landslide, falling celestial bodies, typhoon, hurricane, cyclone, lightning, deluge or overflow of natural or artificial water courses.
The maximum liability of the Insurer is limited to €60,000.00 (sixty thousand euros) per event. In the case of losses that exceed this amount, compensation will be distributed evenly between the Insured Persons affected by the event. An event is defined in items 3.1 and 3.2 of this article.
Article 5 – Travel Termination
The Insurer guarantees to refund the irrecoverable costs relative to the unused days of the journey, including return transport to the point of departure (economy class aeroplane ticket, or 1st class train ticket). This applies to the Insured Person and their Companions, up to a maximum of 4, for any of the causes described in this article, up to a maximum of €5,000.00 per event.
For the purposes of determining unused days, the amount refunded is the total irrecoverable cost of the journey, minus the cost of air transport, divided by total number of days of the journey, multiplied by the number of unused days.
The costs covered by this article are refunded in the following situations:
1 Death, Serious Illness or Serious Accident of:
1.1 The Insured Person, their spouse, or 1st or 2nd degree ascendants or descendants of either, as well as:
siblings, brothers-in-law, sisters-in-law, sons-in-law and daughters-in-law of either.
1.2 The person whose duty it is, during the period of travel of the Insured Person, to take care of minors or other dependent relatives who are legally in their charge.
1.3 The person who has replaced the Insured Person at work during their period of absence.
For the purposes of this item, a serious illness or accident is defined as described in items 1.1.1, 1.1.2 and 1.1.3 of article 4.
2 A sudden or chance event that demands the presence of the Insured Person in Portugal in one of the following situations:
2.1 Loss at the residence of the Insured Person, caused by robbery, fire, explosion or flood and that causes damage amounting to more than 50% of the total value of the contents, or 50% of the total value of the structure.
2.2 Car accident in Portugal that results in serious bodily harm to third parties necessitating a hospital stay of over 2 days, if the driver of the vehicle responsible for the accident is the spouse of the Insured Person, or a 1st degree descendent of either, and as long as the accident is not excluded under the conditions of the standard Automobile Civil Liability insurance policy currently in force in Portugal.
2.3 Persons who are called to testify as witnesses in court.
2.4 Persons who are called count votes in the following elections: Presidential, European, General and Local.
2.5 Persons who receive an unexpected call for a surgical operation.
2.6 Persons who are called for an organ transplant.
2.7 Complications in the first six months of pregnancy, except if predicted, of the Insured Person, their spouse or people in their charge.
2.8 Reception of an adopted child.
3 As cover for travel termination, this contract also covers the following situations:
3.1 Inhabitability of the Insured Person’s destination Hotel (or equivalent), due to a loss resulting from: earthquake, flood, fire, explosion, landslide, typhoon, hurricane, cyclone, lightning and falling celestial bodies, deluge or overflow of natural or artificial water courses; and that causes damage amounting to more than 15% of the total value of the contents, or 15% of the total value of the structure.
3.2 Declaration of a disaster area by the local authorities of the country, or through international organisations such as the World Health Organisation or equivalents, that prevents the Insured Person making use of the days they have purchased. Included in this point are: earthquake, flood, fire, explosion (not cause by any of the exclusions described in article 7), landslide, falling celestial bodies, typhoon, hurricane, cyclone, lightning, deluge or overflow of natural or artificial water courses.
The maximum liability of the Insurer is limited to €60,000.00 (sixty thousand euros) per event. In the case of losses that exceed this amount, compensation will be distributed evenly between the Insured Persons affected by the event. An event is considered to be any of the situations described in items 3.1 or 3.2 of this article.
Article 6 – Obligations in case of loss
6.1 Immediate cancellation of the journey with the Tourism Operator or Travel Agent to avoid fines and charges. This should be done in writing within 24 hours following the loss, and the Insured Person must provide proof that they have sent this document to the Tourism Operator or Travel Agency.
6.2 Inform the Insurer immediately by telephone, providing as much detail as is available. Their lines are open 24 hours a day, 365 days a year. 6.3 Send to the Insurer by fax a copy of all the details in their possession, medical and other reports, the original receipt of payment for the journey, as well as proof of the Irrecoverable Costs.
6.4 Make all possible efforts to identify who is responsible for the event in question and communicate this information to the Insurer.
Article 7 - Exclusions
7.1 This insurance policy does not cover claims that are not presented to the Insurer in accordance with article 6 – Obligations in case of loss.
7.2 In the specific case of serious illness, the Insured Person must inform the Insurer in good time in order to allow it to confirm through its Medical Services the information provided by telephone or medical report.
7.3 Wilfully worsening the effects of the loss or intentionally impeding efforts to amend the situation.
7.4 Making use of fraud, false statements or any other dishonest means, including fake documents, to support a claim.
7.5 Injuries or illnesses existing before reserving the journey;
7.6 Mental illness or any other psychiatric disorder;
7.7 Accidents resulting from an illness or pathological state existing before the start of the journey, as well as injuries resulting from surgery or other medical procedures not undertaken as a result of an accident guaranteed in this contract;
7.8 Suicide or attempted suicide of the Insured Persons and its consequences, as well as other intentional acts performed by the Insured Persons on themselves;
7.9 Dishonest or criminal acts, or acts against public order, for which the Policy Holder or Insured Person is materially or morally responsible, or in which they were accomplices;
7.10 Acts or omissions of the Insured Person that are influenced by the use of narcotics without medical prescription, or alcoholic beverages that result in a blood alcohol level equal to or above the legal permissible limit for driving.
7.11 Expenses related to prosthetic limbs, glasses and contact lenses, as well as dental treatment;
7.12 Accidents resulting from the training or practice of an amateur or professional federated sport, as well as the practice of ‘special’ sports such as mountain climbing, boxing, karate and other martial arts, bullfighting, parachuting, hang-gliding, delta-wing, all sports designated as ‘extreme’, caving, underwater fishing, winter sports, any sports involving motorised vehicles (2 wheels or others), speedboating and other such dangerous sports;
7.13 Accidents resulting from use by the Insured Person of two-wheeled motorised vehicles or quads;
7.14 Deliveries and pregnancy complications, except in the first 6 months.
7.15 Assault, strikes, labour conflicts, riots and any other public order disturbances, rebellion, acts of terrorism and sabotage or insurrection;
7.16 Revolution, civil war, invasion and declared or undeclared war on a foreign country, hostilities between foreign nations with or without a declaration of war, and belligerent acts occurring as a direct or indirect result of these hostilities;
7.17 Accidents resulting from use by the Insured Person of aircraft or vessels not belonging to commercial lines or carriers;
7.18 Accidents resulting from explosions or any other events directly or indirectly related to the splitting or fusion of atomic nuclei, as well as the effects of radioactive contamination;
7.19 Treatment at spas or beaches and, in general, cures involving fresh air or relaxation, as well as aesthetic treatments, physiotherapy and other such procedures.
7.20 All services contracted directly at the destination, or not acquired through the Policy Holder.
Article 8 – Subrogation
Wherever claims made under this insurance policy involve the rights of an insured person against responsible third parties, once the claims are fulfilled, the Insurer will be subrogated the relevant rights, actions and resources against the above-mentioned third parties, except if these are also insured persons.
